(1) According to this Act, the investigation and investigation of cases related to offenses punishable by imprisonment for up to one year shall be done by the employees of the provincial government appointed by the provincial government by publishing a notice in the provincial gazette.
(2) According to this Act, the investigation and investigation of cases related to offenses punishable by imprisonment for more than one year shall be carried out by the employees of the Government of Nepal appointed by the Government of Nepal by publishing a notice in the Nepal Gazette.
(3) If a person is punished with imprisonment of less than one year and another person is punished with imprisonment of more than one year for the same offence, investigation and investigation of that case sub-section
(2) will be done by the employee.
(4) After completion of the investigation and investigation of the offense under this Act, if it is deemed necessary to file a case, the investigating officer shall submit the evidence and evidence related to the investigation along with his opinion to the relevant public prosecutor's office for a decision on whether or not to proceed with the missile case.
(5) On receipt of the missal as per sub-section (4), if the case is not prosecuted by the relevant public prosecutor's office, the time limit for filing the case should be mentioned and if the case is to be prosecuted, the person who should be prosecuted and the charges against him and the claim to be included in the indictment. The missile should be sent back to the investigating officer without exceeding it.
(6) Notwithstanding anything contained in sub-section (5). If the public prosecutor's office studies the missile received, if it is found that further investigation is required on the matter, the matter to be further investigated must be determined and the missile must be sent back to the investigating officer along with the basis and reason thereof.
(7) Upon receipt of a memorandum to further investigate a matter in accordance with sub-section (6), the investigating officer shall re-submit the memorandum to the public prosecutor's office with a demand for the proposed indictment to further investigate the matter and file a case.
(8) After receiving the missile according to sub-section (7), the relevant public prosecutor's office shall decide whether or not to proceed with the case according to sub-section (5) and send the missile back to the investigation officer.
(9) According to sub-section (5) or (8) after the decision to proceed with the case from the public prosecutor's office and receiving the missile, the investigation officer shall file the case before the officer handling the case on behalf of the Government of Nepal.
